1. SCOPE OF APPLICATION.
The offer and / or sale (online) on the product site constitutes a distance contract governed by articles 50 and ss. of Legislative Decree 06.09.2005, n. 206 ("Consumer Code") and by Legislative Decree 09.04.2003, n. 70 (so-called regulation of electronic commerce). The purchase of products on the site is allowed only to those who have reached the age of majority. The customer is required to carefully read the general conditions that EsteticaeD3sign makes available, as well as all other information relating to before and during the purchase procedure.

2. DEFINITIONS.
Pursuant to art. 3, I comma, lett. a) of the Consumer Code, must be understood as: consumer the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out. Hereinafter, therefore, the consumer will be defined. At the end of the contract, the meaning referred to in the following article no. 8; by law, a working day must be understood as any day of the week, with the exception of Saturdays, Sundays and public holidays.

3. CONCLUSION OF THE CONTRACT.
The purchase of products on the site can take place following the completion of the appropriate order form and forwarding to the seller following the instructions on line. In the order form, the customer must indicate what is of interest by specifying: the code, color, size, brand and product description. Before proceeding with the final transmission of the order, the customer will be able to identify and correct any data entry errors by following the instructions that accompany the purchase phases; the customer must then expressly approve the general conditions of sale, whose reading, confirmation and acceptance, through a link, is a mandatory field.

Following the transmission of the customer's order, an e-mail of receipt-order and subsequently the acceptance-order of EsteticaeD3sign will follow. The customer undertakes to hold the order for three working days from the time of sending. Upon receipt of the order acceptance, a binding contract between the customer and EsteteticaeD3sign must be considered. On the contrary, after three working days from the transmission of the order, in the absence of the acceptance-order of EsteteticaeD3sign, the customer's proposal will be automatically considered ineffective.

EsteteticaeD3sign reserves the right to refuse orders:

that they come from a customer with whom it has an ongoing dispute;

that they come from a customer who has previously violated the conditions and / or terms of the purchase agreement;

that come from a customer who has been involved in fraud relating to payments by credit card or other;

that come from customers who have released false, incomplete or in any case inaccurate identification data;

that come from subjects other than final consumers;

that have a shipping address located in an area not reached by the seller

The contract will be concluded with the confirmation of the acceptance of the order, within three working days, by EsteteticaeD3sign, which will be sent to the e-mail address indicated by the customer in the order form, to which a copy of the present conditions of sale. The order form will be filed in the EsteteticaeD3sign database for the time necessary to execute it and, in any case, in accordance with the law.

4. PRODUCT TECHNICAL SHEET.
Each product is accompanied by a technical sheet that illustrates its main characteristics based on the information provided by the manufacturers of the goods bearing the brands. EsteticaeD3sign will do its best to ensure that the images published represent the products offered for sale as faithfully as possible. However, the colors of the products may differ from the real ones due to the settings of the computer systems used by users for viewing. Product images may differ in size. For the purposes of the purchase contract, the description of the product contained in the order form sent by the customer will prevail.

5. PRICES.
The prices published on the site, in line with market parameters (so as not to debase the prestige of the brand), are in Euros and are inclusive of VAT. Delivery costs are charged to the customer, for orders with a total amount up to Euro Twenty-nine / 00, while for orders with a total amount exceeding Euro Twenty-nine / 00, the shipping costs will be borne by EsteticaeD3sign, unless otherwise indicated. of the data sheet. The seller reserves the right to change the price of the products at any time; in any case, the price of the product charged to the customer will be that indicated on the site at the time of the order and that any changes (increase or decrease) subsequent to the transmission of the same will not be taken into account.

6. METHOD OF PAYMENT.
The payment of the price can be made by one of the means indicated on the site during the purchase procedure. In case of payment by credit card, the full price will be charged at the time of order acceptance by EsteticaeD3sign
In order to guarantee data security, EsteticaeD3sign declares that all data relating to the credit / debit card used by the customer will be sent directly, via a protected protocol, to the bank in charge of providing the remote payment service, taking care to prevent any unauthorized and unauthorized access by third parties.
The data entered by the customer during the payment phase may be used by EsteticaeD3sign when this is necessary in order to make a refund in favor of the customer, in the cases provided for by these general conditions of sale and / or by law.

7. EXPENSES AND DELIVERY TERMS.
For deliveries, EsteticaeD3sign will use a carrier of its choice, and if the item is available, it will ship it, having confirmed the payment or successful completion of the financial transaction, within the following 7 (seven) working days, except for complications. In case of unavailability of an item, EsteticaeD3sign will reimburse the customer for any advance payments of the price within ten working days from the notification of unavailability, without any right of the latter to any compensation item.

EsteticaeD3sign will not be responsible for non-delivery or delayed delivery due to force majeure. The risk of accidental loss of the shipment remains with EsteticaeD3sign until delivery.

Product deliveries are made by EsteticaeD3sign or directly by manufacturers or wholesalers to the destination address indicated by the customer in the order form. Delivery to some locations considered "remote" by EsteticaeD3sign could also be excluded

The Customer must check upon receipt of the EsteticaeD3sign acceptance-order that the product delivered corresponds to what is indicated in the transport document and / or accompanying invoice in advance via e-mail; that the packaging is intact, not damaged, wet or otherwise altered; that the closing materials (adhesive tape or plasticized straps) have not been tampered with in any way; that the product bears the disposable guarantee seal of EsteticaeD3sign

8. RIGHT OF WITHDRAWAL.
Pursuant to articles 64 et seq. of the Consumer Code, the consumer has the right to withdraw from the product purchase contract without any penalty and without specifying the reason, within fourteen days of delivery of the product. In the event of withdrawal, the Customer will not be entitled to any indemnity or compensation for any reason, except for the right to a refund of any amount already paid as a price. To exercise this right, the customer can use two procedures:

- Recondition the products in their original packaging, making sure that all products are in the same condition in which they were received, with labels and tags and disposable guarantee seals intact;
- Deliver the returned products to the courier indicated by EsteticaeD3sign, within ten working days of receiving the goods;
- EsteticaeD3sign, after verifying that the returned products are intact in all their parts, as indicated above, will send an e-mail confirming acceptance of the return and will, within five working days, return the price of the products purchased, withholding the transport costs related to the return.
In the event that the withdrawal has not been exercised in accordance with the provisions of art. 64 and ss. consumer code or the provisions of the simplified procedure and, in particular, in the event that the product is not intact in all its parts and / or accompanied by its accessories and / or elements that form an integral part of it and / or lacks the original packaging and disposable guarantee seal or even when it is damaged or used by the customer, it will not result in the termination of the contract and, consequently, will not give the right to a refund. The Product will therefore remain at EsteticaeD3sign at the customer's disposal for collection which must take place at the expense and responsibility of the Customer within 30 days of sending the return refusal e-mail.

9. DATA PROTECTION AND INFORMATION CONTENT PURSUANT TO ART. 13 D. LGS. 196/2003.
EsteticaeD3sign adopts the technical and organizational measures to safeguard the security of the sales service, the integrity of data relating to traffic and electronic communications, in order to avoid the risk of dispersion, destruction and loss of confidential and non-confidential information relating to its users, or of unauthorized access, or non-compliant with the law. The personal data requested when placing the order are collected and processed in order to satisfy the customer's requests, for the correct execution of the order (also through the transmission to the commercial partners involved in the management of the payment, in the execution of the order and / or shipping of the item), for any complaints regarding the warranty of the item and / or recommendations or instructions to the customer regarding the item.

The storage and processing of the aforementioned information will take place in accordance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree no. 196 of 30.06.2003 and subsequent amendments. In this case, the same subjects will operate as independent data controllers or will be designated as data processors or persons in charge of the processing.

Furthermore, the customer always has the right to obtain from EsteticaeD3sign: a) the updating, modification and integration of personal data; b) the cancellation of personal data processed in violation of the law c) the attestation that the operations referred to in letters a) and b) have been brought to the attention of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible or burdensome with respect to the protected right.

The customer also has the right to object, in whole or in part, to the processing of personal data for the purpose of sending advertising or direct marketing material or for carrying out market research or commercial communication. EsteticaeD3sign, according to the adopted privacy policy, applies the following principles:

1. processes the data exclusively for the purposes and in the manner illustrated in the information presented at the time of their collection; .
2. uses the data for purposes other than those for which the data have been specifically released only where the user's express consent is present;
3. makes the data available to third-party companies only for purposes that are instrumental to the provision of the requested service and in the context of an appointment as data processor; does not sell or transfer data to third parties, for their own processing, without the users having been informed in advance and have granted their consent;
4. responds to requests for cancellation, modification, integration of the data provided, opposition to the processing of data for the purpose of sending commercial and advertising information;
5. ensures correct and lawful management of data, safeguarding the privacy of users and applies suitable security measures to protect the confidentiality, integrity and availability of the data provided. 10. APPLICABLE LAW, JURISDICTION.
These general conditions of sale for use and privacy policy (hereinafter referred to as general conditions) are entirely governed by Italian law. For any dispute, deriving from or connected with these general conditions and / or with the individual contracts between EsteticaeD3sign and the consumer, including those relating to the interpretation, execution and possible resolution of the same, the Court of residence or domicile of the consumer.

11. CHANGES TO THE GENERAL CONDITIONS.
The applicable general conditions are those in force on the date of transmission of the purchase order; they can be modified at any time, and any changes and / or updates will be effective only from the moment of their publication on the site, which the customer will take care to verify. By placing the order, the customer becomes aware of and expressly accepts the general conditions valid at the time of the conclusion of the contract. The careful reading of the general conditions of sale, and the inherent approval, represent a conscious negotiation of every single clause.
